Commenting on today’s announcement by Railtrack of its interim results which show half year pretax profits of £236m, the Rail Regulator, Tom Winsor, said: "The level of revenues and profits is a matter for the periodic review and I will be issuing my provisional conclusions next month.

"However, I must emphasize that it is the Regulator who decides what the level of access charges should be and what Railtrack should deliver for those charges

"On Railtrack’s performance so far this year, I am hopeful that my publication of a draft enforcement order has had the desired effect and that their achievements will be mirrored in no penalty payments being paid."
