Railtrack lodges appeal against Rail Regulator's enforcement order

Railtrack has today lodged an appeal against the Rail Regulator's enforcement order of 24 November in respect ofperformance targets. Railtrack wishes to establish whether the proposed size of the fine is proportionate in relation to precedent. Railtrack believes that whilst targets can play a role in improving train punctuality they must be achievable and their penalties reasonable.

The Regulator's enforcement order requires Railtrack to reduce delays to passenger trains by 12.7% by 31 March 2000 with a penalty of £4 million for each percentage point by which it fails to meet this target.

This appeal will not distract Railtrack from continuing to apply its best endeavours to reducing train delays and to meeting its wider public service obligations. Since 1995/96, Railtrack has reduced infrastructure-related train delays by over 40%, a period during which the network has experienced strong traffic growth.

Railtrack also remains committed to working constructively with the Rail Regulator to provide the right framework across the industry to deliver further improvements.
