Better contracts for a growing railway

The Rail Regulator, Tom Winsor, has today published the second consultation document on standard clauses for track access agreements. This second document sets out the key issues that have emerged in consultation with the railway industry since the Regulator launched the consultation process on 7 January 2000.

Commenting on today’s document, Tom Winsor said:

"I have been greatly encouraged by the enthusiasm which has been shown by all concerned for the work to establish standard clauses. Standard clauses help to set in place better track access agreements that will assist franchise replacement and ensure that railway companies, including Railtrack, are properly empowered in their business relationships. The consultation process has tapped the expertise of everyone in the industry in a constructive and open manner. This means that the debate will take place once with maximum information available, instead of in a series of partially informed bilateral negotiations. It is my present view that simpler and clearer arrangements will be in everyone’s interest."

Notes for editors:

Section 21 of the Railways Act 1993 empowers the Regulator to require or encourage the use of standard clauses in new track access agreements between Railtrack and train operators. The Regulator does not have powers to require amendments to extant access agreements, and the present consultation excludes those aspects of a track access agreement which are being dealt with under the periodic review of Railtrack’s access charges.
